Terms and Conditions

Users are required to carefully read these Terms and Conditions in full and may contact PT Abadi Singapay Indonesia ("PT ASI" or "Singapay" or "We") if they have any further questions. These Terms and Conditions govern the User's use and access to the application, content, and products provided by Us, as well as the payment services offered by Us. By accessing or using the Singapay service application, the User agrees and commits to comply with these Terms and Conditions (hereinafter referred to as the Terms and Conditions) and the Privacy Policy as listed on a separate page, which forms an integral and inseparable part of these Terms and Conditions.

I. Definitions

  1. Non-Premium Account refers to a Singapay Account owned by a Non-Premium User.
  2. Premium Account refers to a Singapay Account owned by a Premium User.
  3. Singapay Account refers to all accounts registered on Singapay by Users and controlled by Users to utilize the facilities provided by Singapay.
  4. Singapay Application refers to the platform provided by PT ASI, where the Singapay Application contains various service features that support User activities as a payment system service in the form of electronic money (server-based) and other supporting services, mobile-based, which can be used through Telecommunication Devices.
  5. Bank refers to a business entity that collects funds from the public in the form of deposits and distributes them to the public in the form of credit and/or other forms.
  6. Calendar Day refers to all days from Monday to Sunday, including holidays, based on the Gregorian calendar.
  7. Business Day refers to any day (other than Saturday, Sunday, or national holidays) when banks are generally open in Indonesia for normal banking business transactions.
  8. Merchant refers to parties, whether legal entities, business entities, or individuals, that process Transactions using Singapay based on cooperation agreements with PT ASI or other forms of cooperation.
  9. Mobile Number refers to the mobile phone or smartphone number registered by the User to access Singapay services.
  10. User refers to any person registered as the owner of a Singapay Account, whether a Non-Premium Account or a Premium Account, and the owner of Singapay Balance as recorded in the Singapay Application.
  11. Non-Premium User refers to Singapay Users who have not completed or do not meet verification requirements.
  12. Premium User refers to Users who have completed verification requirements by uploading a face photo and ID card to the User account or by other methods determined by Singapay from time to time.
  13. Telecommunication Devices are mobile phones or cellular phones (cell phones, handphones), or smartphones, tablet-shaped personal computers, or other telecommunication devices that use the Android and/or IOS Operating Systems, with technology that supports the Singapay service.
  14. Promotion or Promo refers to the offering of promotional benefits and/or incentives for using features and services on Singapay payments that have specific terms and conditions related to those promotional benefits and/or incentives. Determining the type and conditions of Promotion is the sole authority of PT ASI. Information, terms, and conditions related to each promotional program and/or incentive will be provided through media that can be easily accessed by Users.
  15. Escrow Account refers to an account at a Bank registered with Singapay, solely used for utilizing the Singapay Application features.
  16. Singapay Balance refers to the amount of electronic money recorded and stored in the Singapay Application. The funds that form the basis for issuing electronic money will be deposited in the Escrow Account and can be used by Users to conduct transactions using the Singapay Application.
  17. Transaction refers to all transactions that can be carried out by Users using Singapay, both those available through the features in the Singapay Application and transactions that will be developed in the future.
  18. Top-up transaction is a transaction of loading electronic money into the Singapay Balance.
  19. Transfer transaction is a transaction of sending electronic money from one User to another User or from one User to a Bank account.
  20. Bill Payment is the payment/purchase of bills or products available on the Singapay application.

II. General Terms

  1. Singapay can only be used after the User agrees to the Terms and Conditions and Privacy Policy in the Singapay Application, and performs activation or registration using a Phone Number (handphone) and provides the required information.
  2. Each Phone Number (handphone) can only be used for 1 (one) Singapay Application registration.
  3. The User can perform any Transaction if they have a sufficient Singapay Balance. The Singapay Balance is limited to:
    1. Rp2,000,000 (two million Rupiah) for a Singapay Account owned by a Non-Premium User;
    2. Rp20,000,000 (twenty million Rupiah) for a Premium Account.
  4. The maximum limit for incoming transactions in 1 (one) Account within 1 (one) calendar month is:
    1. Rp20,000,000 (twenty million Rupiah) for a Singapay Account owned by a Non-Premium User; or
    2. Rp40,000,000 (forty million Rupiah) for a Premium Account.
  5. We may delay or reject Transactions if Our security system deems the Transaction unusual for security reasons. The status of the User's transaction will be directly informed to the User through the transaction page in the Singapay Account.

III. Activation

The User can open an account for the first time by:

  1. Downloading the Singapay Application directly through the Telecommunication Device as available on the Google Play Store (for Android) and App Store (for IOS) and installing it on the Telecommunication Device.
  2. After installation on the Telecommunication Device, the User can perform the activation process by following the instructions and providing information, including:
    1. The User's account name;
    2. A PIN chosen by the User;
  3. At the time of initial registration, the User's status is a Non-Premium Account. If the User intends to upgrade from a Non-Premium Account to a Premium Account, the User will be asked and agrees to upload a facial photo and personal ID card. Every request for a Premium Account registration will be considered a valid request from the User.
  4. All data or information submitted by the User for Premium Account registration will be stored by Us to verify the User's Premium Account request and will be used for the Facial Verification authentication method as outlined in these Terms and Conditions.
  5. The approval or rejection of the User's verification request is entirely at Our discretion, taking into account applicable laws and regulations.
  6. We may delay, reject, or cancel the approval of the User's verification request if, among other things, the following are found:
    1. Misuse of the User's identity;
    2. Identity that does not comply with applicable laws and regulations.
  7. The User must ensure the truthfulness and accuracy of all data and information provided for the activation of the Singapay account or verification of the Premium Account. The User is fully responsible if it is later discovered that the data or information provided by the User is inaccurate, incorrect, and/or falsified.
  8. Singapay, in accordance with its policy, reserves the right to reject the User's registration request if there are indications of identity or profile discrepancies in accordance with applicable laws and regulations. The User will be informed of the registration status through the Singapay Application.
  9. By activating the Singapay account and/or verifying the Premium Account, the User understands and agrees to grant Us access to the name or contact phone number on the User's electronic device for use in connection with activities on the Singapay Application.
  10. To conduct transactions on the Singapay Application, the User must first perform a Top-Up Transaction.
  11. Singapay does not store any information used by the User in transactions related to passwords (PIN) or other security codes in any form, either temporarily or permanently, in Our system. The validation process for transactions conducted through the Bank or transaction provider will be handled directly by the relevant Bank or transaction provider.
  12. The Top-Up Transaction process through the Bank or Transfer Transaction to the Bank will be handled and processed through the banking system. We will only forward the "Success" or "Failed" transaction status from the Bank.
  13. If the Top-Up Transaction is declared "Successful," the User's balance in the relevant Bank account will automatically decrease, while the Singapay Balance will increase accordingly. If the Singapay Balance has not increased, the User can contact Us through the services provided by Us.
  14. The User understands that Top-Up Transactions conducted through third-party channels may experience system and/or network disruptions from time to time, beyond Our control. We will make reasonable efforts to resolve disruptions with third-party channels.

IV. Singapay Application Features

The User can perform various Transactions through the features available on the Singapay Application, which broadly include the following:  

  1. Singapay Balance
  2. Top Up (Balance Recharge)
  3. Bill Payment
  4. Purchase of Recharges
  5. Transfer Between Users
  6. Bank Transfer

V. Duration

The User’s Singapay account will remain valid as long as the account is not permanently closed, either by the User or by Singapay.

VI. Singapay Account Blocking

  1. The Singapay Account may be blocked entirely or partially, in accordance with Our policy, under the following circumstances:  
    1. The User enters the wrong PIN 3 (three) times consecutively;  
    2. The User submits an official request, either due to a report that the mobile phone has been lost, stolen, or hacked. The User must provide additional information/documents related to the request.  
    3. Singapay unilaterally blocks the account due to indications of harm to Singapay and/or indications of violations of applicable laws, with or without prior notice to the User, including:  
      1. A request from a state authority or authorized law enforcement agency;  
      2. The User's use of Singapay services that results in a violation of the Terms and Conditions and/or Privacy Policy;  
      3. The User provides false or misleading data/information during registration or while using the Singapay Application;  
      4. Indications of misuse for activities that violate applicable laws and regulations;  
      5. The Singapay Account is declared inactive (dormant) due to no usage for a minimum period of 12 (twelve) consecutive months, meaning no transaction activity (incoming or outgoing transactions) and/or no activity on financial services assets and/or liabilities in the Singapay Application.  
  2. The reactivation of a blocked account due to the reasons mentioned above is entirely at Singapay's discretion. We also reserve the full right to temporarily or permanently deactivate the User's access to part or all of Singapay's services/features.

VII. Closure and/or Deletion of Singapay Account

  1. The Singapay Account may be closed and/or deleted due to the following reasons:
    1. A formal request from the User submitted through Our official complaint channel and/or via the delete account feature on Singapay, fulfilling the required processes and conditions as requested by Us;
    2. A request from authorized law enforcement agencies;
    3. Singapay's policy, provided it does not conflict with applicable laws and regulations;
    4. Force Majeure conditions lasting for 3 (three) consecutive months or more; and/or
    5. The cessation of PT ASI's operational activities for any reason.
  2. We will return the Singapay electronic money balance to the User upon account closure and/or deletion after deducting any outstanding fees (if applicable), unless We determine that withholding a portion of the balance is necessary, such as in cases of reasonable belief that the funds are related to or resulted from fraud, misuse of the Singapay Account, indications of other legal violations, or breaches of these Terms and Conditions.
  3. Regarding the closure and/or deletion of the Singapay Account, the User and Singapay agree to waive the applicability of Article 1266 of the Indonesian Civil Code concerning the requirement for a court decision to close the Singapay Account and/or terminate these Terms and Conditions.
  4. In the event of account closure and/or deletion due to a User request, the User has the right to close/delete the Singapay Account and terminate their relationship with Us under the following conditions:
    1. Submit a formal request to Us by logging into the Singapay Application and completing the available steps.
    2. The User is obligated and responsible for withdrawing all remaining funds in their Singapay Account before closing the account, including but not limited to withdrawing and/or emptying their Singapay Balance.
    3. The User understands and agrees that the request to delete their Singapay Account through the Singapay Application is made by the User as the authorized owner of the account, and the User will be required to verify the account deletion.
    4. The User must provide reasons, suggestions, and feedback during the account deletion request process.
    5. As a security measure, the User must enter their PIN when processing the account deletion.
    6. Singapay has the authority to determine the timeframe for processing the account deletion until completion.
    7. Singapay has the authority to reject the account deletion request.
    8. During the review and approval process for account deletion, the User can still access the Singapay electronic money platform but cannot perform any transaction activities.
    9. The User is given the opportunity to cancel the account deletion request as long as the deletion process has not been completed.
    10. If the User cancels the account deletion request, Singapay will immediately stop reviewing the deletion request.

VIII. Limitation of Liability

  1. To prevent misuse of data or the Singapay Account, the User must remember and maintain the confidentiality of their information, including the phone number used for the Singapay account or an alternative phone number, PIN, verification code, OTP, or other data provided or received by the User related to transactions or activities conducted through Singapay. The User is fully responsible for any consequences and risks arising from their failure to maintain the confidentiality of their information.
  2. The User must safeguard the aforementioned information from events such as loss, damage, misuse by unauthorized parties, or forgery. The User hereby acknowledges and agrees to release Singapay from any liability or compensation for incidents beyond Singapay's fault or negligence, including but not limited to:
    1. Loss or damage to the User's telecommunication device or phone number;
    2. Unauthorized access to the User's personal information occurring outside Our responsibility or through third-party applications;
    3. Any losses resulting from the User's suspected violation of laws or unauthorized misuse by third parties;
  3. The User is required to verify, ensure, and guarantee that all information and data registered or provided while using Singapay is accurate, true, and complete, and not misleading. Therefore, the User releases Us from any claims, demands, and/or compensation arising from the User's failure to comply with these Terms and Conditions.
  4. Once a transaction is completed, the User acknowledges and agrees that the transaction cannot be reversed for any reason and will be processed based on the information and data registered and entered by the User.
  5. The User will be charged fees related to Singapay services in accordance with Our policies, including transaction fees and other costs, which will be informed to the User based on Bank Indonesia regulations. Singapay Users must use telecommunication data services and are responsible for arranging such connectivity, including data access tariffs. Costs and usage terms will be governed by the User's telecommunication service provider.
  6. All losses, including costs, interest, damages, or losses of any kind (including personal injury, emotional distress, and loss of data, goods, income, profits, use, or other economic benefits) are the User's responsibility.
  7. All losses, including delays or other costs, interest, damages, or losses of any kind (including personal injury, emotional distress, and loss of data, goods, income, profits, use, or other economic benefits) caused by system failures or issues with banks or Singapay partners beyond Our control, provided We have processed them, are the User's responsibility.
  8. Apart from the above, any losses incurred by the User due to Singapay's negligence will be borne by Singapay, and complaints can be submitted through the provided channels: Singapay's official email at customer.care@singapay.id and phone number 021-38929036.
  9. Singapay is obligated to notify Users of any changes or developments affecting products, official channels, or any aspects impacting Users, at least 30 working days before the changes take effect.

IX. Force Majeure

The non-performance or delay in performing part or all of Our obligations under these Terms and Conditions will not be considered a breach if caused by events beyond Our control, commonly referred to as Force Majeure, including (a) natural disasters, (b) fires, labor strikes, wars, riots, rebellions, or other military actions, (c) actions by authorized institutions affecting telecommunication services, (d) actions by third parties preventing Us from providing telecommunication services, (e) decisions by authorities or government changes impacting Singapay services, including tariff changes, and (f) epidemics, pandemics, or disease outbreaks. The User agrees to release Singapay from any claims if We cannot fulfill the User's instructions due to Force Majeure.

X. Transaction Security and Confidentiality

  1. We prioritize the security and comfort of Users when using Singapay services. Therefore, We have security systems in place to ensure that User transactions are safe, and personal information is stored and used in accordance with Our Privacy Policy and applicable laws.
  2. We use adequate servers to protect the confidentiality of User information. All sensitive information is transmitted using Secure Socket Layer (SSL) technology, ensuring that only authorized personnel can access it.
  3. We implement reasonable measures to ensure that the User's PIN is not disclosed to anyone except the User to prevent misuse. Thus, the User is fully responsible for maintaining the confidentiality of their PIN.

XI. Declarations and Warranties

  1. The User declares and warrants that they are legally competent to use the services provided by Us under applicable laws and regulations.
  2. For Premium Account upgrades, the User declares and warrants that they are legally capable of entering into agreements or other forms of cooperation under Indonesian law, specifically bound by these Terms and Conditions. The User, when accessing, registering, and/or using the Singapay Application, is at least 17 (seventeen) years old and not under guardianship.
  3. The use of the Singapay Account and/or services constitutes the User's acknowledgment and agreement to comply with (i) these Terms and Conditions, (ii) the Privacy Policy, and (iii) all applicable laws and regulations.
  4. The User declares and warrants that they will use the Singapay Application fairly in accordance with these Terms and Conditions and applicable Indonesian laws and will not take any actions aimed at bypassing, penetrating, or exploiting security vulnerabilities or causing disruptions or damage to Singapay's systems, misusing the Singapay Account, products, or features within the Singapay Application, or causing losses to Singapay and/or other Users. The User is responsible for all consequences of violating these terms.
  5. The User declares and warrants that the funds used in transactions are not derived from criminal activities prohibited under Indonesian law, and the Singapay Account is not opened for money laundering or terrorism financing purposes. The User is fully responsible and releases Us from any claims if they are found to have engaged in money laundering under applicable laws.
  6. The User declares and warrants that they will use the Singapay Account securely, maintain the confidentiality of their User ID, PIN, OTP, and other information that could lead to misuse of their account.
  7. The User agrees to provide additional data or documents requested by Us for further investigation of suspicious transactions or suspected violations of these Terms and Conditions, the Privacy Policy, or applicable laws.
  8. The User will not grant any rights, authority, or power to any third party to use their data, account, or PIN. The User is prohibited from transferring their Singapay Account to any other party under any circumstances.
  9. The User declares and warrants that they will not request the return of any data/documents submitted to Us, and We are entitled to use such data for transaction services or administrative purposes related to the User's Singapay Account, unless required by law.
  10. The User declares and warrants that they will update and inform Us of any changes to their registered data.
  11. By conducting transactions through Singapay, the User understands that all communications and instructions received by Us will be treated as authentic evidence, even if not in written form. The User declares and warrants that they will not dispute the validity of electronic communications and instructions submitted through Singapay as authentic evidence.
  12. The User acknowledges and agrees that the services provided through Singapay are offered "as is" and "as available," without any warranties from Us that the services will meet the User's specific needs. Singapay does not guarantee that (i) the use of Singapay will fulfill all User requirements, (ii) the Singapay Application will be continuously available without interruptions/errors, or (iii) any discrepancies in the Singapay Application will be corrected to meet User expectations. However, We will make reasonable efforts to provide the best possible service to Users.

The resolution timeframe for User complaints follows Bank Indonesia regulations, with a maximum of 20 working days, depending on the nature of the complaint.

XIII. Miscellaneous 

  1. These Terms and Conditions are governed by and construed in accordance with Indonesian law.
  2. These Terms and Conditions apply to all Users who access and/or use any or all Singapay services available on the Singapay Application and related services provided through the Singapay Application or other applications published by Us from time to time.
  3. In the event of disputes regarding the interpretation or implementation of these Terms and Conditions, We and the User agree to resolve the dispute through mutual discussion. If no agreement is reached, the User may submit complaints to dispute resolution bodies or Bank Indonesia. If these methods are unsuccessful, the dispute will be resolved by the Tangerang District Court.
  4. Singapay, including its name, logo, codes, designs, technology, and business formulas, is protected by copyright, trademarks, patents, and other intellectual property rights under Indonesian law.
  5. Our failure or delay in taking action, imposing sanctions, or enforcing Our rights or obligations, and/or filing claims or demands for breaches of these Terms and Conditions, does not waive the User's obligations or Our rights to take necessary actions in the future.
  6. The User is prohibited from transferring their rights and obligations under these Terms and Conditions without Our prior consent based on Our sole discretion. The transfer of all or part of the Singapay Balance to any third party does not constitute a transfer or assignment of the Singapay Account.
  7. If any provision of these Terms and Conditions is found to violate applicable laws, the offending provision will be severed, and the remaining terms will remain valid and binding.
  8. These Terms and Conditions, including the features or services offered by Us, may be amended, updated, and/or supplemented from time to time based on Singapay's policies. Any changes will be communicated to the User.
  9. The User acknowledges and consents to Our use of their personal data/information for the development of Singapay services, in accordance with the Privacy Policy and applicable laws.
  10. The management of User personal data is governed by the Privacy Policy, which is an integral part of these Terms and Conditions. By agreeing to these Terms and Conditions, the User also accepts the Privacy Policy.
  11. User transactions conducted through Singapay are automatically stored on Singapay's servers. The User acknowledges that We have made reasonable efforts to secure Our systems. However, in the event of discrepancies, the data, balance, or transaction records maintained by Us will prevail.
  12. The User understands that by using Singapay, their personal data will be collected, used, and displayed to enable them to enjoy Singapay services to the fullest.

XIV. Final Provisions

The User understands and agrees that these Terms and Conditions constitute an electronic agreement, and the User's action of pressing the register or login button or checking the consent box when accessing Singapay constitutes their agreement to be bound by these Terms and Conditions, which are legally valid and binding for as long as the User uses Singapay. We may transfer Our rights under these Terms and Conditions by informing and/or notifying the User.

Singapay reserves the right to make changes to products, services, Terms and Conditions, and the Privacy Policy from time to time based on applicable policies. Any changes will be communicated to the User at least 30 working days before they take effect.

The User will be notified of changes through one or more of the following methods:

  1. In-app notifications in the Singapay Application
  2. Email to the registered email address
  3. Announcements on Singapay's official website
  4. Other communication methods deemed appropriate by Singapay

By continuing to use Singapay services after the effective date of the changes, the User is deemed to have read, understood, and agreed to the changes. If the User does not agree with the changes, they may contact Singapay's customer service or choose to discontinue using the services in accordance with applicable procedures.

Premium Account

Users can open an account for the first time by:

Downloading the Singapay Application directly via their telecommunication device from the Google Play Store (for Android) or the App Store (for iOS) and installing it on the telecommunication device.

  1. After installing the application, Users can activate their account by following the instructions and providing the following information:
    1. The account name chosen by the User;
    2. A PIN selected by the User;
    3. When initially registering, the User's status will be Non-Premium. If the User wishes to upgrade from a Non-Premium Account to a Premium Account, the User will be required to upload a photo of their face and personal ID (KTP). Each Premium Account registration request will be considered a valid request from the User.
    4. All data or information submitted by the User for Premium Account registration will be stored by Us for the purpose of verifying the Premium Account request and will be used for Face Verification authentication as outlined in these Terms and Conditions.
    5. Approval and/or rejection of the User's verification request is solely at Our discretion, in compliance with applicable laws and regulations.
    6. We may delay, refuse, or cancel approval of a User's verification request if there is evidence of:
      1. Misuse of User identity
      2. Identity that does not comply with applicable laws and regulations.
    7. The User must ensure the accuracy and correctness of all data and information provided for Singapay account activation and Premium Account verification. The User is fully responsible if it is later discovered that the data and information provided are inaccurate, incorrect, or false.
    8. Singapay, at its discretion, has the right to reject a User's registration request if there is an indication of identity or profile mismatch according to applicable laws and regulations. The status of the User's registration will be communicated through the Singapay Application.
    9. By activating the Singapay account and/or verifying the Premium Account, the User understands and agrees to grant Us access to their name and/or phone number contacts on their electronic device for use in connection with activities on the Singapay Application.
    10. To perform transactions on the Singapay Application, the User must first complete a top-up transaction.
    11. Singapay does not store information used by Users in making transactions in connection with passwords (PIN) or other security codes in any form, either temporarily or permanently into Our system. The validation process for transactions made through the Bank or transaction organizer will be carried out directly by the Bank or the relevant transaction organizer.
    12. Top-up transactions through banks will be processed through the banking system. We will only forward the transaction status as “Successful” or “Failed” from the bank.
    13. If a top-up transaction is marked as “Successful,” the User's balance in the respective bank account will automatically decrease, and the Singapay balance will increase by the corresponding amount. If the Singapay balance does not increase, the User may contact Us through the services provided.
    14. Users understand that top-up transactions through third-party channels may experience system and/or network disruptions from time to time beyond Our control. We will make reasonable efforts to resolve issues with third-party channels.
Closing and/or Deleting a Singapay Account
  1. The Singapay account may be closed and/or deleted due to any of the following reasons:

    1. A formal request from the User submitted through our official complaint channels and/or through the delete account feature on Singapay, subject to the processes and requirements set by us;
    2. A request from authorized law enforcement authorities;
    3. Singapay's policies that do not contradict applicable laws and regulations;
    4. Force Majeure conditions occurring for 3 (three) consecutive months or more; and/or
    5. Termination of PT ASI's operational activities for any reason.
  2. We will return the Singapay electronic money balance to the User upon account closure and/or deletion, after deducting any outstanding fees (if any), unless, based on our consideration, it is necessary to withhold a portion of the Singapay balance, for example, due to a reasonable belief that the amount is related to or caused by fraud, misuse of the Singapay account, indications of other illegal activities, or violations of these Terms and Conditions.

  3. In relation to the closure and/or deletion of the Singapay account, the User and Singapay agree to waive the applicability of Article 1266 of the Civil Code, as far as it pertains to requiring a court decision for the closure of the Singapay account and/or termination of these Terms and Conditions.

  4. In the case of account closure and/or deletion of the Singapay account due to a User's request, the User has the right to close/delete the Singapay account and terminate their relationship with us under the following conditions:

    1. Submit a formal request to us by logging into the Singapay application and completing the available steps.
    2. The User must and is responsible for withdrawing all remaining funds from their Singapay account before closing the Singapay account, including but not limited to withdrawing and/or emptying their Singapay balance;
    3. The User understands and agrees that the request for account deletion through the Singapay application is made by the User themselves as the authorized owner of the Singapay account, and the User will be required to verify the account deletion.
    4. The User must provide reasons, suggestions, and feedback during the account deletion request process.
    5. As a security measure, the User must enter a PIN code when processing the account deletion.
    6. Singapay has the authority to determine the time frame for the account deletion process until completion.
    7. Singapay has the authority to make a decision to reject the account deletion request.
    8. During the account deletion review and approval process, the User can still access the Singapay electronic money platform but cannot perform any activities or transactions.
    9. The User is given the opportunity to cancel the account deletion request as long as the account deletion process has not been completed.
